Terms and conditions

Your holiday rental of our villa (Villa Monte Palmeiras) will be subject to the following terms and conditions:

The legally binding Agreement for Holiday Rental of the private villa (“property”) detailed on the Booking Form is between its owners, David and Theresa Wade (“we”/”us”/”our”), and the person designated on the Booking Form as Party Leader (“you”/”your”) and is made up of the information detailed on the Booking Form and the following Terms and Conditions:

  1. The Rental Period shall start and end on the dates shown on the Booking Form. Unless otherwise agreed in writing the property will not be available for occupation until 14:00 hours on the first day of your rental period and you must vacate by 10:00 hours on the last day of your rental period. We reserve the right to levy additional charges for delayed departure.
  2. In the case of completion of the booking form using a paperless process first payment shall be deemed as acceptance of the Agreement in lieu of signature.
  3. Only those people detailed on the booking form (the “party”) (and confirmed by us in documentation issued by us prior to the start of your rental period) can stay at the property and if unauthorised persons are present at the property we reserve the right to levy extra charges and/or require them to leave. You (the Party Leader) must be a member of the party staying at the property throughout the rental period and you shall be responsible for ensuring all members of your party accept and adhere to these Terms and Conditions
  4. You and your party shall have exclusive use of the property during the rental period. You acknowledge your occupation of the property is as a short-term holiday rental and no rights to tenancy or occupation beyond the rental period will arise. You and your party shall not assign, sub-let, charge or part with or share possession or occupation of the property or any part of it.
  5. The price (“Villa Rental Price”) for your holiday rental is detailed on the booking form. The Total Rental Price may also include Additional Items you may choose to select at the time of booking (or otherwise) as detailed on the booking form.
  6. Your booking will be confirmed by us only after the completed booking form has been received by us and the non-refundable Booking Deposit detailed on the booking form has been received in our account. If the start of the rental period is within 6 weeks of booking, payment in full must be received before your booking can be confirmed. We will issue a Booking Confirmation to you to confirm your rental period and our acceptance of the Agreement.
  7. The booking deposit is accepted as an instalment of the total rental price and 6 weeks before the start of your rental period you will pay us the balance (Balance Payment). We will not send out reminders for this payment which should be made in a timely manner. In the event that the balance payment is not paid on time we reserve the right to cancel or re-sell all or any part of the rental period without compensation.
  8. When you pay the balance payment you will also pay us a Security Deposit as detailed on the booking form. We will bank this and hold against any undue damage, loss or breakage incurred during your stay:
  • If there are no problems we will refund 100% of this deposit to you within 7 days of the end of your rental period.
  • If we need to retain any or all of the security deposit we will present you with a detailed invoice for the charges applied.
  • The security deposit reserved by this clause shall not limit your liability to us in the event of major loss or damage.
  1. Cancellation by you, or any change to your party, must be advised to us in writing. The following cancellation charges will apply:
  • More than 6 weeks before start of rental period: cancellation charge equal to the booking deposit.
  • 6 weeks or less before start of rental period: cancellation charge equal to 100% of the Villa Rental Price.
  1. In the event of unforeseen circumstances that force us to cancel or modify your rental period our liability will be limited to refunding the full amount paid by you to us and compensation shall be limited to this sum.
  2. We employ the services of a Local Property Management Agent (“agent”) to look after the property and represent our interests. The agent will make suitable arrangements for you to access the property on arrival and will be available to answer any queries you may have about the property during your stay.
  3. The property will be in accordance with our advertising and descriptions unless otherwise advised in writing and equipped for the number of persons in your party. We will ensure the property is well-maintained and cleaned and prepared for your arrival. All bed linen, crockery, cutlery, hand and bath towels are provided for your stay:
  • You are required to bring your own towels for the pool and beach (and bed-linen for the cot, if required).
  • You need to provide your own supplies for the house (soap, toilet-paper, etc)
  • Car hire, flights, travel insurance and other arrangements are your responsibility to organise and book.
  1. We will ensure all utilities (electric, water, internet, etc) will be connected and bill payments are up to date. However, we will not be liable to you for any defect or stoppage in the supply of public services beyond our control. Drainage is to Portuguese standards, so please be aware that toilets/drains can be easily blocked, and if blocked as a result of unsuitable items being flushed then the charge for unblocking will be to your account.
  2. You acknowledge the property is a private home and has not been purpose-designed for rental. It is important you familiarise yourself with the property, make your own assessment of its inherent and potential dangers and ensure all members of your party are fully aware of safety issues. We ask you to read the safety notices in the information folder in the property and alert you to the dangers of the swimming pool and to the potential consequences of over-exposure to the sun and/or excessive consumption of alcohol. We cannot accept any liability for accidents howsoever caused as you and your party must be responsible for taking any and all necessary precautions.
  3. We ask you to take care of the property as if it were your own home. In the event of loss or damage in the property or defects or breakdown in the equipment and appliances you will without delay report to us or our agent, and arrangements will be made for repair or replacement as soon as reasonably possible. You will allow access to the property for the purposes of cleaning, repair and maintenance.
  4. You will be liable to make good and fully compensate for loss or damage caused by your actions or negligence. Also if you leave the property excessively untidy, dirty or with undue amounts of rubbish, you may be charged for additional cleaning. Such charges will be set at the discretion of the agent and will not be negotiable.
  5. You will be responsible for the correct and decent behaviour of your party whilst at the property and any breach of this may result in us or the agent requiring you and your party to vacate the property without compensation.
  6. No pets are allowed at the property.
  7. Smoking is not permitted inside the property.
  8. We cannot accept any liability for the action of any person(s), the occurrence of any incident, the supply of any information or services over whom or which we have no direct control.
  9. Whist every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things may change and you accept that minor discrepancies will not be cause for complaint or refund.
  10. If You have a problem or complaint you must contact the agent within 48 hours so it may be dealt with. Failing this you must contact us within 48 hours of the problem arising. Complaints should then be reported to us in writing within 2 weeks of your return.
